JULY 27, 2011

Pursuant to notice made to the newspaper of general circulation throughout Grant County, the radio station in Grant County and e-mail distribution list, a regular meeting of the County Court was held at the County Courthouse in Canyon City OR.

9:00 am — Call to Order. Present were Judge Mark R. Webb, Commissioners Scott W. Myers and Boyd Britton, Secretary Mary Ferrioli and Pastor Sharon Miller. A Pledge of Allegiance was given to the United States flag. The invocation was given by Pastor Miller.

PROGRAM. MSP: Webb/Myers — to accept the program with adding a request to expend reallocated Liquor Law Funds to Item E, a Contract with Eastern Oregon Building Maintenance as Item G and an Executive Session under 192.660(2)(a) at 10:30 am.

9:10 am – News Reporter Scotta Callister entered

ANNOUNCEMENTS.

Webb would be with Blue Mountain Partners this afternoon for forest tour about the next project with the Forest Service, plus associated meetings tomorrow. He has a meeting with the Umatilla NF the morning of August 1 to talk about collaborative efforts and a Community Counseling Solutions board meeting in Boardman that afternoon.

Britton reported on a July 26 meeting with the new ODOT District Manager and some local property owners. He said he also had informal conversations with Forest Service reps about grazing and fish issues.

MINUTES. MSP: Myers/Webb — to approve the minutes of July 20 as amended.

INTERIOR SECRETARY. Webb asked the court for a county response to a letter from the USDI BLM requesting input on the identification of “crown jewels” within Grant County to consider for wilderness status. Britton pointed out that the lack of forest management only leads to disease and the risk of wildfire. Myers believed a “hands-off” approach is not the best for forest health or the survival of natural resources.

FAIR BOARD. Webb asked the court what it would like to do about the Fair Board President’s request for a joint meeting between the County Court and the Fair Board to review proposed changes to duties and procedures that might benefit the community. Webb suggested that we ask for a clear definition of what the Fair Board wants to change. He added that current practice is based on the county’s understanding of the relevant state statutes. Britton suggested a meeting

between the Fair Board President, the Treasurer, and a Court member to discuss the implication of budget laws. It was pointed out that the county has gone through the same issues every few years which continually need clarification due to conflicting state statutes. It was felt it could be useful to have a public meeting with the Fair Board to become clear about what they want to accomplish. Then a detailed proposal can be reviewed by legal counsel to determine how that might be accomplished. Specific concerns involve jurisdictional authority, statutory accountability, and legal liability.

9:30 am Ken Boethin and Rob Stewart entered

JUVENILE CRIME PREVENTION. Juvenile Department Director Ken Boethin recommended signing the 2011-2013 Intergovernmental Agreement with Oregon Commission on Children and Families to receive Juvenile Crime Prevention funds. While funding for the biennium totals $45,000, the county has been asked to only obligate funds for this fiscal year. Funds are to support intervention services for youth referred to the department and the Probation Counselor’s salary. MSP: Britton/ Myers — to authorize Judge Webb to sign the Juvenile Crime Prevention Intergovernmental Agreement.

On behalf of the Grant County Public Safety Coordinating Council, Boethin provided the Community Corrections biennial plan for court approval. The plan, developed by the Adult Parole and Probation department and Local Public Safety Coordinating Council, would be attached to the IGA with DOC. Boethin addressed the adult sex offender treatment program operated by Community Counseling Solutions, polygraphs, alcohol and drug services, and various treatment tools. Court members signed a letter approving the plan.

COMMUNITY CORRECTIONS. Community Corrections Director Ken Boethin recommended signing the 2011-2013 Intergovernmental Agreement with Oregon Department of Corrections to allow the county to assume administrative responsibility for correctional supervision and services as outlined in the plan. Community Corrections goals in Oregon are to: reduce criminal behavior, enforce court orders, assist offenders to change, and provide restitution to victims and the community. Boethin talked about the department’s ability to implement approved administrative sanctions, intensive supervision techniques, community service, mental health services, and employment. Boethin addressed outcomes related to duties and responsibilities associated with effectively managing offenders. He added that the funds are provided up front and unexpended money may be carried over to the next year. MSP: Myers/Webb — to authorize Judge Webb to sign the one year Intergovernmental Agreement with Oregon Department of Corrections.

10:00 am — Cleo McCluskey entered

DA’S SHREDDER. District Attorney Legal Assistant Cleo McCluskey requested approval to purchase a shredder to replace the one that stopped working in February. Since then the office has been using the DA’s personal shredder, but that one now no longer works. Quotes were provided for a heavy-duty shredder from Amazon.com @ $127.84, Staples @ 179.99 and Quill @ $199.99. McCluskey recommended getting the low cost Royal Machines 17-Sheet Heavy Duty Shredder with free shipping from Amazon @ $127.84. She said this shredder would also take CDs and DVDs and has a one year warranty. MSP: Webb/Myers — to approve purchasing the Royal Machines 17-Sheet Heavy Duty Shredder from Amazon. Treasurer Smith pointed out that Central Supply has oil for shredders in stock which needs to be used on a regular basis.

10:05 am – Sgt. Gordon Larson entered

LIQUOR LAW. District Attorney Legal Assistant Cleo McCluskey requested approval to purchase three additional VieVu video cameras for the Oregon State Police totaling $2,637.00 from last year’s unused Liquor Law funds. Those funds had been reallocated to the 2011-2012 General Fund on June 30th. Sgt. Gordon Larson said the cameras, worn on the officers’ lapel, are durable and have proven to increase the prosecution rate. He added that arrests for DUII, primarily made by OSP troopers, have also increased. Webb stated that Treasurer Smith felt the purchase should wait until revenue is received this year due to difficulty tracking last year’s revenue for this year’s purchase. Webb personally was inclined to use the money to provide state-mandated county services for which the state has cut funding. He thought the state could not provide this equipment for their agents. Britton supported the request with the condition that the DA completes his Drug Court grant report. In response to Myers’ question about the availability of funds, Treasurer Smith said Liquor Law fees are starting to go down but money usually comes in monthly. Myers asked how important it was to receive the cameras right away. Sgt. Larson indicated that the need for them now isn’t critical, but would enhance troopers’ ability to protect the community. MSP: Myers/Webb — to approve purchase of the cameras with monies received this fiscal year. Webb noted NO for reasons previously given. He would prefer to help underwrite the county’s Community Corrections program which is seeing reduced state funding. Sgt. Larson was familiar with unfunded mandates and understood the Community Corrections office is in need of further funding. McCluskey reported that the DA is working on the Drug Court report which the court will receive when completed.

10:30 am – Mark Hensley entered

ROAD. Roadmaster Mark Hensley appeared with bids for chip oil that he just received from Albina Asphalt of Portland in the amount of $356,785.00 and Idaho Asphalt Supply Inc. of Nampa ID in the amount of $338,525.00. Hensley said he expected to hear this week when the new Chip Spreader will be received. MSP: Webb/Myers — to approve the apparent low bidder, Idaho Asphalt, in the amount of $338.525.00 contingent upon the department’s compliance review.

USE OF FACILITIES. The court reviewed and approved an Agreement for Use of Facilities at the fairgrounds. The agreement would allow the Grant County Piecemakers to use the Pavilion for an event this September 9 – 11. MSP: Webb/Myers — to allow Judge Webb to sign the Agreement for Use of Facilities for the September 9 – 11 event.

PROPERTY LEASE. Court members reviewed and signed the Second Amendment to a Commercial Property Lease with State Senator Ted Ferrioli for use of office space located at 530 E. Main Street in John Day. The amendment extends the current lease through December 31, 2012.

FLU SHOT PROVIDER. The court reviewed and approved a Regence Flu Shot Program Participating Provider Agreement to provide flu shots to eligible members through March 31, 2012. MSP: Webb/Britton — to authorize Judge Webb to sign the Regence Flu Shot Program Participating Provider Agreement.

CLEANING SERVICES. Court members reviewed and signed a Contract for Goods and Services That Cost Less Than $25,000 with Eastern Oregon Building Maintenance to provide twice monthly cleaning services to the OSU Extension office located at 530 E. Main Street in John Day. The Extension Agent had solicited bids from local service providers this spring and subsequently awarded the contract to Eastern Oregon Building Maintenance.

The court also signed Extension District Warrant No. 015 previously provided by Extension Agent Gary Delaney.

U.S. ECONOMY. Local rancher Sharon Livingston had previously sent an email request to have the County Court contact the offices of US Senator Ron Wyden and US Senator Jeff Merkley to ask them to call a hearing on Cut, Cap, and Balance on the Senate Floor and proceed to vote for the same.

EXECUTIVE SESSION. At 10:45 am the court entered Executive Session under 192.660(2)(a) to

Consider the employment of a public officer, employee, staff member or individual agent.

Webb recited the State Attorney General’s Sample Script to Announce the Start of Executive Session. No motion was made upon returning to General Session.
