IN AND FOR THE COUNTY OF GRANT

SEPTEMBER 19, 2012

Pursuant to notice made to the newspaper of general circulation throughout Grant County, the radio station in Grant County and e-mail distribution list, a regular meeting of the County Court was held at the County Courthouse in Canyon City OR.

9:03 am — Call to Order. Present were Judge Mark R. Webb, Commissioners Scott W. Myers and Boyd Britton, Secretary Mary Ferrioli, Pastor Eric Bortell and Commissioner Candidates Chris Labhart, Mike Cosgrove and Mick Dougharity, Watermaster Eric Julsrud, Assistant Watermaster Hailey Boethin. A Pledge of Allegiance was given to the United States flag. The invocation was given by Pastor Bortell.

CLAIMS. The court had reviewed and approved claims and Extension District Warrant No. 156.

AGENDA. MSP: Myers/Webb — to accept the program with deleting the request to relocate the Commission on Children & Families office to a larger space and adding discussion on roof replacement assessment and specifications for the Courthouse and Criminal Justice Facility.

ANNOUNCEMENTS.

Webb spoke with OWEB Intensive Watershed Monitoring representatives last night about the need to incorporate what they are doing in a larger effort to get landowner buy-in. A meeting and tour had been scheduled for today. Webb spent two ½ days last week at the Health Department for the states site review and would be there again this afternoon.

Myers will meet with Devin Moan Friday at 10:00 am to discuss what the North-Central ESD HUB situation will look like after elimination of Commission on Children and Families on June 30, 2013.

Britton, Judge Webb and Chris Labhart had attended a Long Creek School presentation on the Constitution last Monday. He would be chairing a Southeast Area Commission on Transportation meeting at the airport next Monday to discuss transportation and road maintenance funding issues. Britton was able to attend part of a South Fork Watershed Council meeting last night at Canyon City Community Hall about appropriate methods and legal issues concerning game poaching by OSP Trooper Marv Ritter, Master Sgt. Gordon Larson and DA Ryan Joslin.

MINUTES. MSP: Britton/Webb — to approve the September 12 minutes as amended.

9:30 am — Devin Moan, Jamie McKay, and Russ Comer entered

CHILDREN AND FAMILIES. Children and Families Director Devin Moan proposed hiring a Prevention Specialist at 20 hours/week for 11 months to fulfill youth coalition duties previously conducted by the AmeriCorps member. If the STOP Act Grant is not awarded, she would like to use $27,500.00 available in A&D 70 funds to support this position beginning mid to late October. The wage and benefit breakdown for the position totals about $27,036.00. A copy of the countys Prevention Specialist job description was provided for review. The position would work in the Drug Free Communities Grant program. Webb noted that any future unemployment cost for this position wont be covered by grant funds. Britton did not like that aspect, but felt that was simply a cost of doing business. If approved, the position would be advertised in-county for one week and then publicly for one week. Britton spoke with Moan about interview questions and the interview process, and also recommended doing a complete criminal background check. Webb clarified that A&D 70 funds pass through Mental Health to the county. MSP: Webb /Myers — to approve hiring a 20 hour/week Prevention Specialist for 11 months associated with the federal Drug Free Communities grant.

9:40 am Ryan Joslin and Cleo McCluskey entered

COURTHOUSE OFFICE SPACES. Britton had asked for a discussion about reconfiguring some offices downstairs. District Attorney Ryan Joslin proposed that the DA and Victim Assistance offices be relocated to the current Juvenile and Adult Services and Watermaster office spaces. Juvenile and Adult Services will soon be relocating across the street from the Courthouse. Currently, the DA and Victim Assistance offices are positioned across the hall from each other. Joslin would like all of his staff located together and needs a more private, secure area that includes private space for Grand Jury meetings. He said use of the Jury Room is restricted to Circuit Court hours and sometimes that creates problems. Watermaster Eric Julsrud indicated, while the Victim Assistance office is too small, the DA office would work. But, he is currently sharing a copier with Planning located at the other end of the hall.

Joslin talked about some interior work involving removal of non structural walls between the small offices and installation of a security window and locked door between the public and staff offices. With court approval, Joslin was more than willing to provide schematic drawings and also his remodeling labor to facilitate the change. McCluskey reported that the county has up to $10,000 available from City County Insurance Service for risk management and security improvements. Joslin added that Judge Cramer may have Court Security funds available for these enhancements. Discussion followed about the need to address confidentiality with a sound barrier between the public and the inner offices. Britton asked the group, including the Planning Department, to come back to court with a comprehensive plan that addresses all of the issues involved.

10:00 am — Sue Newstetter and King Williams entered

TITLE 3. County Title 3 Coordinator Sue Newstetter recommended accepting proposed Title 3 Projects in compliance with the SRS and Community Self-Determination Act reauthorized for 2012 under PL 110-343: Firewise Community Program, Search & Rescue and other Emergency Services on federal land, and Community Wildfire Protection Plans. The 45-day public comment period closed on September 7; no written comment was received. Revised guidance by the Forest Service stipulates that Title 3 projects be initiated by September 30, 2012 and funds obligated by September 30, 2013. MSP: Webb/Myers — to approve the 2012 Title 3 projects as advertised.

Newstetter addressed the General Accountability Offices report and new recommendations from the Forest Service about restrictions in the use of Title 3 funds for the project categories described above. She and the court reviewed the various types of activities that are either allowed or not allowed associated with projects under the new SRS Title 3 program. Newstetter indicated she would be meeting with Irene Jerome on October 17 to begin work on applying the new regulations to Grant County projects.

10:30 am — Patrick Bentz and Kevin Bissell entered

RUNWAY 9/27 REHAB PROJECT. Airport Manager Patrick Bentz recommended county signature on the 2012 Runway 9/27 Rehabilitation Project agreements. The single signature documents include: Connect Oregon 4 Grant Agreement, Strata Proposal to provide geotechnical engineering evaluation, T-O Engineers, Inc. Agreement for Professional Services, FAA Application for Federal Assistance for 2012 AIP, and FAA Sponsor Certifications for 2012 AIP. T-O Engineers Project Manager Kevin Bissell was also present. Britton asked for clarification from Bissell about the need for geotechnical engineering, as he believed it may have already been done. Bissell explained the need to determine the soil type for the required FAA testing prior to beginning the project. He indicated that Benchmark Surveying would be doing all the required surveying. Myers confirmed with Bissell that he would be responsible for tracking all expenditures and reimbursements. Bissell explained that both grants are reimbursement programs and invoices would be managed and submitted to the granting agencies and the county by T-O Engineering. Bissell and Bentz talked about an allowance to use Connect Oregon funds to initiate the design work followed by reimbursement with FAA AIP funds. MSP: Myers/Britton — to authorize Judge Webb to sign the agreements for the 9/27 Runway Rehabilitation Project.

FOREST SERVICE LEASE. Airport Manager Patrick Bentz requested signature on a USDA Forest Service Lease for Real Property totaling $4,200.00 per year from October 1, 2012 through September 30, 2032. Bentz said that the lease is a renewal for the airbase. The area is approximately 0.64 acres containing approximately 28,000 square feet of land and improvements at the Regional Airport in John Day. Court members preferred to wait until next week to allow time to further consider the annual lease rate amount. Webb planned to contact the Forest Supervisor to negotiate a rate increase for the new 20 year lease.

11:10 am Brenda Percy entered

PUBLIC RECORDS REQUEST. The court discussed a public records request for a machine readable electronic version of the 2012-2013 County Budget document. Shaun Robertsons records request includes a fee waiver under ORS 192.440(5). Hes currently working with some organizations and taxpayers to promote programs such as predator and noxious weed control and would like to investigate the opportunity for county funding. Clerk Brenda Percy explained that she previously sent Robertson the budget document in electronic form, but is wasnt organized in the form that he wants. She explained that Chaves Consulting could create the budget document in the desired format, but it would cost approximately $150.00 to prepare. Percy added that Chaves told her this format request is normally only requested by auditors. Some discussion followed about Robertsons request to waive the $150.00 fee. The court felt that its obligation under the public records statute had already been satisfied. It had been suggested that Robertson may want to contact Chaves Consulting directly with his special reformatting request. Webb planned to send a written reply to Mr. Robertsons request.

NATURAL HAZARDS MITIGATION PLAN. The court talked about Oregon Emergency Managements recent offer to provide assistance with updating the countys FEMA-approved Regional Natural Hazards Mitigation Plan thats due to expire sometime next year. The plan includes Baker, Grant, Union and Wallowa counties, as well as Baker City, Halfway, John Day and La Grande. It is the only multi-county regional NHMP in Oregon. OEM expects to receive a FEMA grant to assist in the updating process that can be matched with local staff time. Once each county has accepted OEMs assistance with the NHMP update then a Scope of Work and letter of commitment would be sent for the project. Webb suggested contacting other counties to see what they are doing, then contracting with another county, such as Baker, to underwrite the plan update. He said he would visit with Baker County representative Mark Bennett then send a letter of response to Oregon Emergency Management. MSP: Myers/ Britton– to allow Judge Webb to coordinate with Baker County on the NHMP update and send a letter to Oregon Emergency Management.
