IN AND FOR THE COUNTY OF GRANT

MAY 1, 2013

Pursuant to notice made to the newspaper of general circulation throughout Grant County, the radio station in Grant County and e-mail distribution list, a regular meeting of the County Court was held at the County Courthouse in Canyon City OR.

9:00 am — Call to Order. Present were Judge Scott W. Myers, Commissioners Boyd Britton and Chris B. Labhart, Secretary Mary Ferrioli, Chaplain and Mrs. Richie Colbeth, and Hank Lissman. A Pledge of Allegiance was given to the US flag. The invocation was given by Pastor Colbeth.

AGENDA. MSP: Myers/Labhart — to accept the agenda with the addition of Item G to discuss an invoice from Grant County Building Supply for ceiling tiles.

ANNOUNCEMENTS.

Britton reported that he has been in contact with Oregon Trail Electric Cooperative about their energy efficiency assistance program and the countys window replacement and HVAC plans.

Yesterday, Myers attended the Community Connections of Northeast Oregon quarterly board meeting in La Grande and met with Trent Wright of Triangle Oil about placement of one or more 1,000 gallon above ground oil fuel tank at the Courthouse.

Labhart had met with Sheriff Palmer about responsibility for inmates receiving medical treatment at the hospital. He has a Community Health Improvement Partnership meeting tomorrow evening at 6:30 pm.

9:15 am — Susan Horn and Circuit Court Administrator Tammy Wheeler entered

Britton had attended a CASA and Heart of Grant County domestic violence candlelight vigil Saturday evening. He had been asked to assist Oregon Department of Forestry in the selection of a new District Forester. Britton reported on his attempts to have conversations with the OTIS elevator company about the possibility of installing an elevator at the Courthouse and a conversation with the Assistant State Fire Marshall about relocating the fire escape from outside the old jail.

9:25 am — Glenn Palmer, Bonnie Britton, King Williams and News Reporter Scotta Callister entered

JAIL SPACE AGREEMENT. Sheriff Glenn Palmer requested the courts signature on a new Intergovernmental Agreement with Wheeler County for the use of Jail Space. The agreement had been approved by legal counsel and allows the county to provide inmate boarding services to Wheeler County as needed at the rate of $50.00 per inmate per day. MSP: Labhart/Britton — to approve the jail space contract between Wheeler County and Grant County as presented. The arrangement would include video conferencing services to Wheeler County when needed.

9:45 am — Sue Newstetter entered

TITLE 3. County Title 3 Coordinator Sue Newstetter recommended approval of a proposed PL 106-393 old Title 3 Project SAR Water Rescue Equipment application. The objective is to purchase water rescue equipment for the Sheriffs Office to use for water rescues around rivers and lakes, including swift water, and provide equipment training. The $13,000 budget previously approved by the Budget Committee includes $5,000 from the Sheriffs budget. MSP: Labhart /Myers — to approve a 45 day public comment period for the Title 3 SAR Water Rescue Equipment proposed project. Sheriff Palmer and Judge Myers signed the Title 3 application.

Newstetter discussed the Title 3 Project Healthy Private Timberlands (HPT) Report Taking the Next Step proposal prepared by Forest Resources Affairs, LLC. The HPT report received in February answered 7 questions regarding the condition of Grant County private timberlands and provided 19 action options with no assigned priorities. Taking the Next Step proposes facilitating a meeting with the County Court and interested parties to review and identify 3 to 5 options with the best potential for assisting private timberland owners. Forest Resources Affairs has offered to do that and prepare a Work Plan for accomplishing each of the action options by June 30. The project cost is estimated at $7,940. Newstetter asked if the court was willing to move forward with an addendum to the current Title 3 project. She felt a number of funding options were available which the Economic Development Coordinator could help the county secure in the future for any identified project(s). MSP: Myers/Labhart — to authorize Ms. Newstetter to create an amendment to the existing Forest Resources Affairs LLC Healthy Private Timberlands Title 3 Project to identify the 3 to 5 action items. Newstetter suggested the HPT Report be distributed to the Governor and State Legislators since it is such an important report. It was noted the report could also be provided to Congressional representatives and other federal officials, as well as private industry and private timberland owners.

10:15 am Kathy Smith entered

PLANNING COMMISSION. The court received Rob Stewarts letter of resignation as an alternate member of the Planning Commission. MSP: Myers/Labhart — to accept Rob Stewarts resignation from the Planning Commission effective immediately.

BUSINESS OPERATIONS PLAN. The court reviewed and discussed the 2013 Business Operations Plan for the USFS Airbase and Grant County Regional Airport Joint Use Facility. The plan is tied directly to the Management and Operating Agreement between the USFS and the county and describes the systems and protocols used by both tenants. The plan had been signed by the Malheur NF Supervisor. MSP: Labhart/Myers — to authorize Judge Myers to sign the Business Operations Plan for the USFS Airbase and Grant County Regional Airport Joint Use Facility.

NATURAL HAZARDS MITIGATION PLAN. The court reviewed and signed a Letter of Commitment with Oregon Partnership for Disaster Resilience (OPDR). It indicates the countys willingness to participate and support the 5-Year Natural Hazards Mitigation Plan update process. The 2012 Oregon Pre-Disaster Mitigation Planning Grant establishes the partnership and requires a $6,000 in-kind or cash match from each participating county — Baker, Grant, Union, and Wallowa. The update ensures continued FEMA compliance, provides an opportunity for local entities to participate in the planning process, and establishes partnerships to achieve mutually beneficial mitigation activities. ODPR would administer the grant, provide planning resources, complete research to support the local plan update, facilitate a series of local work sessions, develop the final draft mitigation plan for the counties / cities in the region, and provide technical assistance on the FEMA plan review process. County employee work hours related to this process would be used for the $6,000 in-kind match. The first Steering Committee meeting is on May 8 from 2-4 pm at the airport. MSP: Britton/Myers — to authorize Judge Myers to sign the Letter of Commitment with Oregon Partnership for Disaster Resilience.

CEILING TILES INVOICE. Treasurer Kathy Smith asked the court for information about an Invoice she received from Grant County Building Supply for 50 boxes of ceiling tiles costing $2,069.50. Smith was not aware the court had approved ceiling tile replacement beyond the Clerks office. She noted that no cost estimate for labor was included in the project. Based on earlier discussion, Britton understood ceiling tiles would be replaced throughout the public areas next. Labhart suggested that a full time person be used so the project would be done more quickly. But, it was felt it was less costly to use a part time maintenance employee rather than a licensed contractor. Smith talked about the need to establish a priority list for ceiling tile replacements and painting. It was agreed that parties could get together on their own to determine the sequence for improvements. Smith cautioned that all available funds might be needed for the HVAC system improvements and decommissioning the underground fuel tank.

10:30 am — Kimberly Lindsay, Russ Comer, and Devin Moan entered

COMMUNITY COUNSELING SOLUTIONS. CCS Director Kimberly Lindsay updated the court on upcoming changes in the states primary Intergovernmental Agreement for the 2013-2015 and another for developmental disabilities which needs to be signed by the County Court, including amendments. Lindsay also talked about a new community treatment program being implemented to deliver services in Grant County involving plans to hire an additional Qualified Mental Health

Associate. Lindsay also gave the court an update on the Warm Line program, the annual Climate Survey by local CCS employees, and the ongoing operations of the Juniper Ridge Acute Care Facility.

Lindsay requested Judge Myers signature on Form 855A and required documents relating to a change in ownership due to the sale of the federally designated Rural Health Clinic under the Public Health Department effective January 1, 2013. Myers was familiar with the transaction and has been communicating with Lindsay about the documents. MSP: Myers /Labhart to authorize Judge Myers to sign the document as presented.

Lindsay talked about the transfer of Prevention Program carryover funds from the Commission on Children and Families. CCF Director Devin Moan and Prevention Program Coordinator Russ Comer were present. Lindsay explained that service A& D 70 funds would come directly to CCS effective July 1. Moan sought clarification about A & D 70 funds coming to CCF in May and June.

Myers pointed out that HB 2013 could possibly extend the CCF through December 31, 2013.

An updated Commercial Property Lease with Community Counseling Services, Inc. for the building at 528 E. Main in John Day was signed by the court. The update reflects occupancy of the entire 8,814 sq ft building with an annual rental rate of $30,000.00. Rent includes use of an on-site train car for storage and maintenance and minor repairs up to 32 hrs per month. The term is from July 1, 2013 through June 30, 2015. The lease was signed by all court members.
