Pursuant to notice made to the newspaper of general circulation throughout Grant County, the radio station in Grant County and e-mail distribution list, a regular meeting of the County Court was held at the County Courthouse in Canyon City OR.
9:00 am — Call to Order. Present were Judge Mark R. Webb, Commissioners Scott W. Myers and Boyd Britton, Secretary Mary Ferrioli, Commissioner Candidates Mick Dougharity, Mike Cosgrove, Chris Labhart and Steve Parsons, Pastor Teresa Aasness, Jim Sproul, and John Morris. A Pledge of Allegiance was given to the US flag. The invocation was given by Pastor Aasness.
AGENDA. MSP: Britton/Myers — to accept the program as presented
ANNOUNCEMENTS.
Webb reported on the public meeting at the airport yesterday evening about the BLM Murderers Creek Wild Horse Management Plan. Monday, he met with State Librarian Mary Kay Dahlgren at the library, who reported excellent changes at the library since her last visit. Last Thursday Webb was in Portland for a Federal Forest Advisory Committee meeting to address federal land management at the state and federal levels.
Myers reported on the emergency preparedness meeting at the airport on Monday hosted by the National Weather Service. Attendees included representatives from the county and Canyon City. Yesterday, Myers chaired the quarterly Community Connection of Northeast Oregon board meeting in La Grande.
Britton commented on individual meetings hes been having with people about issues concerning OTEC, DEQ, the permitees, and stream bank alteration standards.
9:15 am Chamber of Commerce manager Sharon Mogg entered
MINUTES. MSP: Britton/Myers — to approve the minutes of October 24 with minimal changes.
BUDGET RESOLUTION. The court reviewed and signed Resolution 12-50 Making Intrafund Transfers / $2000.00 from Maternal & Child Health to Personal Services for existing health department employees to perform duties for the new adult immunization program.
PROPOSED ORDINANCE. Court members discussed a proposed ordinance prepared by legal counsel, Adopting All-Terrain Vehicle Use on County Roads within Grant County. The ordinance is proposed to be considered within the public hearing process. Webb noted that local citizens have encouraged the court to adopt such an ordinance. Dates for holding two public hearings were identified as November 7 and 21. Britton did not support the ordinance at this time. He believes it may lead to trouble in the future caused by citizens from outside the county.
SUPPORT FOR PETITION. The Grant County Public Forest Commission previously provided the court with a Petition to De-Federalize Oregon Lands and to Return Public Land Ownership Rights to the Chartered Counties of Oregon. Mike Dubrasich, Director of the Lebanon-based group Give Us Our Land Back, will be meeting with Forest Commissioners and other interested parties at the Senior Citizens Center in John Day at 6 pm on November 7. The Wallowa County Board of Commissioners had signed the petition and the Grant County Court was being asked to sign it. Webb felt a number of things in the petition were correct about mismanagement of federal lands; however, he felt it was full of legally inaccurate claims. He believed that legal counsel would feel the same. Myers said hed like to speak with Wallowa County Commissioner Mike Hayward about what he thinks we may gain by signing the petition.
9:30 am — News Reporter Scotta Callister, King Williams, Zach Williams, Dave Traylor, Dave Paddock, Brian Whitman, Bud Irvin, Sheriff Palmer, and Mike Smith entered
Copies of the petition were made available to attendees and they were told where to find it on the website. General discussion took place about various actions taken in Apache County AZ around this issue. Webb felt stewardship contracting under Forest Service guidelines has been working well for us. Discussion followed about origination of the petition. Traylor felt the petition was a little premature for Grant County because we dont have all of the information yet. He felt the county was being proactive by holding a local meeting with the Give Us Our Land Back group. King Williams provided some background on what has been done on this issue within Wallowa County and talked about his understanding of proposed legislation thats being considered around this concept.
Court members planned on inviting Mr. Dubrasich to attend their November 7 meeting.
10:00 am — Mark Hensley entered
SNOW REMOVAL. Roadmaster Mark Hensley spoke with the court about this years winter snow removal coverage area and work schedule. Hensley was preparing a public notice for the newspaper and wanted the courts opinion on the subject. He said 7 days per week coverage can be handled by hiring more people, or we can wait until theres snow on the weekend and current employees can be called out for overtime. Hensley reported on timing for the scheduled snow routes which takes school buses and commercial hauling into account. He said work hours are going to be flexible according to the need. Webb thought 5 day coverage with weekend on-call was a more cost effective way to run. Hensley explained the likelihood of more public complaints if we arent there every day. He added that its important to keep in mind the department will spend $1 Million more to operate this year than the revenues received. The year after, it will be $2 Million more spent than received. Hensley posed the question, do we want to spend more money than is taken in to provide services, or look at cutting services? He talked about the ongoing difficulty dealing with the publics increasing expectations with decreasing revenues, plus issues about compliance with mandates and work zone procedures. Hensley said that, if four or five inches of snow falls in Harney County on the weekend, the public has to manage without the countys help Harney County doesnt even have a sander. Webb indicated that snow wasnt plowed on the weekends last winter in Baker County. He felt safety would not be compromised if people take ownership of their driving. It was noted that Baker County citizens use chains to get around in the snow. Sheriff Palmer believed it boils down to individual responsibility. Webb recommended providing 5 day service with weekend plowing on call as needed. Britton suggested that Hensley be allowed the discretion to go to 7 days, if needed.
10:40 am — Kimberly Lindsay, Jan Kile, Kathy Smith, Donna Adams, Devin Moan and Russ Comer entered
COMMUNITY COUNSELING SOLUTIONS. CCS Director Kimberly Lindsey introduced Jan Kile as the newly hired Director for Juniper Ridge Acute Care Facility. Kile reported on the various activities she has been conducting to initiate the process of getting the facility up and running.
Lindsey talked about CCSs contract with the Commission on Children & Families for prevention services. CCF Director Devin Moan was present for the discussion. As of July 1, 2013, CCF program functions will take on a new form under the state-wide Early Learning Council. Lindsay said our contract stipulates that prevention funds, now totaling about $70,000.00 annually are to go to CCF. She wanted the court to know she and Moan are talking about the prevention programs future. Moan said a decision needs to be made about where to house the prevention office after next June. Lindsay said the ultimate responsibility for state A&D 70 prevention services falls to the local community mental health program. She believed CCS was probably the only local agency with the experience needed to operate a prevention program. Moan added, the Drug Free Communities Program has a separate funding stream, but oversight would be provided by the agency operating prevention services. Lindsay explained how CCS would be able to accommodate the office space needed for prevention services.
11:00 am — Dean Hoodenpyl entered
ADULT PAROLE / PROBATION. Adult Parole / Probation Director Dean Hoodenpyl recommended that misdemeanant supervision fees be raised from $35 to $50 per month to be in line with surrounding counties. He would also like to allow more misdemeanant cases to be supervised. Hoodenpyl recommended changing the one-time $35 Bench Community Service fee to a monthly fee of $15 to encourage the completion of service. He reported that hes discussed a higher level of misdemeanant supervision and proposed fee changes with the DA and Circuit Court Judge, and both support that idea. Hoodenpyl indicated this is an area that Department of Corrections does not fund, so fee increases would generate some compensation.
MSP: Webb/Myers to approve the supervision fee increase and the Bench Community Service fee change as recommended.
Britton talked with Hoodenpyl about ways in which his department handles clients who fail to pay supervision fees.
Hoodenpyl reported that last budget year he was approved to purchase two computers through his adult services grant — but they were never purchased. Treasurer Kathy Smith stated that money should have carried over, but she didnt think it was in his Capital Outlay line. She said she would look into moving the funds by resolution for the purchase.
JUVENILE CRIME PREVENTION. Juvenile Department Director Dean Hoodenpyl reported that the Central and Eastern Oregon Juvenile Justice Consortium meeting he recently attended addressed the possibility of the federal juvenile services grant being cut next biennium. Or, Juvenile Crime Prevention funds could be shifted to the county or another entity, rather than remaining as a reimbursement grant. He said these topics will be discussed further at the Association of Oregon Counties conference next month.
HEALTH DEPARTMENT. Former Health Department Business Manager Donna Adams was present today to answer questions about budget reporting for the federal grant. Treasurer Kathy Smith said Adams was here in case Kimberly Lindsay had questions about the budget report. She said the idea was for Adams to give clarification while everyone involved was in the same room; however Lindsay was no longer present. Adams stated it is against the law to make a profit from federal grant dollars. She explained that the $30,000.00 shown on the report is only on paper for the purpose of showing the clinic is not profiting from the federal grant. Adams said the $30,000.00 is shown as payment for employee wages (not profit). She was previously given instructions by federal auditors about how to complete this report. Clients who dont have Medicare, Medicaid, or any third party insurance must pay out-of-pocket according to a sliding scale discount. Adams said those people are being seen and federal grant dollars are used accurately later to make up the difference. She further explained each line and entry on the accumulative budget report, including employee costs and the reduced fees received. Adams said she keeps track of each income source and whether it was paid by cash or check, so accumulative costs can be carried to the next quarter. Smith explained, for the purpose of this report, Adams is only tracking the money generated by the Medicare, Medicaid and non-insured clients.
Britton sought further clarification from Adams about income generated from the grant. She explained the difference between income received from grant funded clients and other income generated from primary care client fees. It was also clarified that Adams figures and Treasurer Smiths figures have been and continue to be the same. The court seemed satisfied with Adams explanation. Smith indicated she did not understand Adams accounting procedures until yesterday.
Adams also answered questions about the financial condition of our primary care program. She stressed the critical need for primary care revenue generated by a Nurse Practitioner seeing patients at least four days a week.
CLAIM. The court approved a $915.00 Bank of Eastern Oregon VISA claim for the Association of Oregon Counties Annual Conference registration fee. Webb, Myers, and the Commissioner-elect are scheduled to attend the event in Eugene November 13 15. The claim was being paid today so next months VISA charges for lodging at the Eugene Hilton Hotel, etc. remain within the credit limit.
